5. Cancellation and Refund Policy

Cancellation and refund requests are handled according to the following terms:

  • Clients may cancel a request before project execution begins, and eligible refunds may be provided depending on the status of the request.
  • Once project development, design, programming, or implementation has started, payments are non-refundable.
  • Hosting and server services are non-refundable after activation and delivery to the client.
  • Refunds do not include external costs, third-party fees, licenses, or services purchased on behalf of the client.

SoftGateX reserves the right to review refund requests individually based on the circumstances of each case.

6. Client Responsibilities

The client is responsible for providing all necessary information and materials required for project completion, including:

  • Content, images, files, and project materials.
  • Accurate project requirements.
  • Required access credentials or accounts when necessary.
  • Timely feedback, approvals, and responses.

Any delays caused by the client’s failure to provide required information or approvals may result in an extension of the project timeline.

7. Project Execution and Modifications

SoftGateX works to deliver projects according to the agreed requirements and scope of work.

Any additional requests or changes outside the original scope may require:

  • Reassessment of project costs.
  • Adjustment of delivery timelines.
  • Approval from both parties before implementation.

Additional features or major modifications are not considered part of the original project unless separately agreed upon.

8. Intellectual Property Rights

Upon completion of the project and full payment of all outstanding fees, ownership rights of the final deliverables created specifically for the client will be transferred to the client.

This includes project-specific deliverables developed as part of the agreed scope.

However, this does not include:

  • Open-source software and libraries.
  • Frameworks and development platforms.
  • Third-party tools, technologies, or components.
  • Pre-existing code, methods, or resources owned or licensed by SoftGateX.

SoftGateX retains ownership of its general technical knowledge, methodologies, tools, and reusable components.

9. Portfolio and Project Showcase

SoftGateX reserves the right to display completed projects in its portfolio or use them as references for marketing and showcasing its technical capabilities.

If a client does not wish their project to be publicly displayed, this request must be agreed upon in advance through written communication.

10. Hosting and Server Services

When providing hosting or server-related services:

  • SoftGateX provides services according to the agreed specifications.
  • The client is responsible for the content and data hosted under their account.
  • SoftGateX does not guarantee 100% uninterrupted availability due to factors beyond its control, including third-party provider failures or global network issues.
  • Data recovery is not included unless a backup service has been specifically agreed upon.
  • SoftGateX is not responsible for data loss caused by client misuse, incorrect configuration, or negligence.

11. Technical Support and Maintenance

SoftGateX provides technical support and maintenance services according to the selected package or agreement.

Maintenance services may include:

  • Bug fixes.
  • Software updates.
  • Performance improvements.
  • Technical assistance.

Maintenance does not include major feature development, redesigns, or significant changes unless separately agreed upon.

12. Limitation of Liability

SoftGateX strives to provide reliable and high-quality services; however, we cannot guarantee that all services will always be completely free from errors or interruptions.

SoftGateX shall not be responsible for:

  • Indirect damages.
  • Loss of profits.
  • Data loss caused by improper use.
  • Issues caused by third-party services or products.
  • Use of services in violation of applicable laws or instructions.

SoftGateX’s liability shall be limited to the maximum extent permitted by applicable law.

13. Confidentiality and Client Information

SoftGateX respects the confidentiality of client information and data provided during project execution.

Client information will not be used, disclosed, or shared except when necessary to provide services or when legally required.
